2004-00-00-From The Treasurer

It has been bought to the attention of the committee that the letter displayed in red (not available) has been received by a selected number of Mi Sol Owners in the UK It is sent by Dianne Carroll who declares herself to be Secretary Of Mi Sol. SHE IS NOT It proposes an AGM on the 17th April 2004. Up to now no one out side Escudero's band of followers has been notified of such a meeting. On the left hand column are our comments on this latest disruption to the harmony of Mi Sol.


1 Antonio Escudero submitted himself reluctantly for election at an AGM of the community of Mi Sol. When he failed to obtain a majority, he started throwing all his toys out of the pram and trying to argue that an election fairly overseen by legal representatives of both parties was somehow flawed.

2 Escudero's 2003 February meeting was attended by owners of 92 plots. This actually translated to 51 actual owners out of our 265. 32 of these were serial debtors leaving just 19 legitimate votes. Their relentless campaign to discredit Pepe with lies and intimidation grew their number to 95 votes at the AGM . Fortuanately for the sensible owners on Mi Sol common sense prevailed and all Pepe's hard work for the community returned him as president despite the attempts to smear his reputation.

3 Truth and Justice! Dianne Carroll is insulting the intelligence of decent owners on Mi Sol. Escudero's version of the minutes of the 2003 AGM are everything but true. Those of us in attendance were at a completely different meeting to the one his minutes reflect. Truth and Justice------ Juan Lavado has one ambition on Mi Sol. The 12000 Euro per year contract to administer it. He has taught us two things. 1: Yes we do need a professional administrator, and both parties will agree on that. 2: He is good. But after the misery that he has made possible many owners are of the opinion that he cannot be trusted. Any attempt to install Juan Lavado as administrator will be opposed by the majority of owners on Mi Sol


4 Dianne you cannot tie our hands behind our backs by freezing bank accounts and causing a cash flow crisis. --------- and then complain that no work is being done on Mi Sol. We never know what bit of nastiness you are going to throw at us next.

We have been forced by you to be cautious with the funds that we have available.

5/6 How strange that after all these accusations that have been leveled at Pepe, the only criminal proceedings attempted to date has been regarding the opening of a bank account in three names. This was done on the advice of our Lawyers in an attempt to prevent a reoccourance of the freezing of our 69000 euros held in the Caja Murcia account. What happened to all the properties that Pepe supposedly bought with Mi Sol Money. IT WAS A LIE !!!

7 All Mi Sol Money is now paid into the Mi Sol Community of Owners Banco Popular Account. Escudero is NOT president, he has no mandate to collect money or appoint Juan Lavado to collect money. Only money paid into Banco Popular will be recognised credits to Mi Sol Owners accounts. Pay to Escudero or Lavado at your own peril!!! YOU HAVE BEEN WARNED

8 DIANNE :- Most of us have ALREADY DECIDED. You are quite right we ARE a DEMOCRACY. WE DEMOCRATICALLY DECIDED THAT WE DO NOT WANT YOU!!!! PEPE was elected WARTS AND ALL.

9 Juan Lavado is NOT PRESIDENT. He was present at the AGM when Pepe was elected. He was one of the "LAWYERS" who counted the votes. HOW CAN THIS MAN CALL AN AGM ON MI SOL?

10 Plenty of hours are contributed free of charge by the community volunteers. The time that is spent by you trying to incite the town hall to serve demolition orders on your fellow Mi Sol Owners is not the kind of representation our owners require.

From The Followers of Antonio Escudero

1 On the 24th January 2004, Antonio Escudero called a meeting of friends to discuss what has been happening, from our point of view, on Mi-sol.

2 As most people know the Community is divided between the followers of Pepe Requeime and Antonio Escuder. From now on known as "Pepe" and "Antonio," both sides have their own opinions and views of what is best for Mi-Sol. Below is a brief account of what is happening at the moment.

3 Everything Antonios' followers have done is through the courts or by Spanish law. We have a lawyer, Juan Lavado of 51 Gabriel Miro, Torrevieja, who is working for us for free. He is looking for TRUTH and JUSTICE. Some people have said he is only an Administrator of Fincas. This is only one of his many jobs. He has given proof that this is true, but still some followers of Pepe refuse to believe this proof. That is their prerogative. Antonio is seeing that the cleaner and the gardener are being paid.

4 Unfortunately, no repair work is being done by either side except for dire emergencies. The sewerage repairs have been done by Juan the gardener. Antonio, Juan, the gardener, Paco Taxi and several other men helped clean and tidy the circles because they were in a very bad state i.e. abandoned building rubbish, weeds, dead trees, bushes, rubbish etc. Pepe’s followers also got a work party (minus Pepe) to paint the front wall of Mi-Sol. It looks good, proving both sides want the BEST for Mi-Sol. The Director of the Caja Murcia bank told Antonio that Pepe had accused the Caja Murcia Bank of stealing his/Mi-Sol's money and was verbally abusive, even going so far as to calling him a pig. The account was then frozen by the Director of Caja Murcia and NO ONE ELSE. He then had the account transferred to a court account in Orihuela. This was done by the Dircetor of the Caja Murcia Bank. The money is still in this account.

5 We also have a criminal lawyer working for us. His name is Martin Marcus from Alicante. The money for his fee was put up by me and I have since been reimbursed. He is also fighting for us, Mi-Sol Community of Owners, on behalf of TRUTH and JUSTICE and those of us who want the TRUTH to be brought to light.

6 In February 2003 an affidavit was submitted to the Torrevieja Court to see if it was possible to prosecute Pepe for misappropriation of funds. We are awaiting a court date for this.

7 We have asked Juan Lavado to accept our money for site fees, water and electric. He has very kindly offered to do this for us so that WE are not in debt to the Community. He will give us an official receipt which will be recognised by the Courts.


8 So, it is up to you what you decide to do. We are a democracy. We will fight to the bitter end for a president who will do what we ask of him and NOT WHAT HE WANTS, i.e. we voted for Agamed to do the sewerage and water but Pepe's man did this work for which he gave a GUARANTEE. Why then was he paid by Pepe for repairs that had to be subsequently carried out?

9 Juan Lavado has convened an A.G.M. for the 17th April 2004. If you cannot make this meeting please let us have your proxy vote ASAP. Unfortunately, there are many things that I cannot inform you of, as they are still awaiting court summons, so please bear with me as it all takes so long in Spain as the courts are so busy.


10 I am sorry this has taken so long to reach you but it has to be translated into Span­ish then agreed by Juan Lavado and Martin Marcos. With work commitments and holidays it takes forever. We are trying to keep costs to a minimum, therefore, most of the work is done out of working hours for FREE.

Every owner on Mi Sol (Whoever they prefer as president) is entitled to fair representation and protection of their democratically elected representatives. How can any one on Mi Sol support a regime that is trying to make trouble for owners who have invested in Mi Sol in good faith.

We offered a solution to the community in 2002 that by now would have legalised every bodies home and secured every bodies future. A result of this would increase values and include homes on escrituras. Proposals were suggested that would mean that this process could have been carried out without any substancial cost to individual owners.

Juan Lavado Dianne Carroll and Antonio Escudero have succeeded in derailing that process with lies and scaremongery.

They have continually presented Mi Sol to the town hall as a problem to the extent that their actions are causing proceedings being taken against the interests of fellow owners.

WHY WOULD YOU DO SUCH A MEAN THING TO YOUR NEIGHBORS?

Letters exist from Dianne Carroll sent in the 1980s were she has incited owners against the so called "Mi Sol Mafia" HER WORDS One can only comment that her skills are improving. She is getting better at it! Please do not be taken in by her.

Personal vendettas should not be allowed to cause us to stray from that basic rule. Since the 2003 AGM We have a strong committee . Who apply themselves to this philosophy. Pepe trusts his committee now a lot more that he was able to in Dianne Carroll's day. He delegates a lot more now which is a good thing, and accepts constructive criticism when it is appropriate. He cannot make capital decisions now without consulting his fellow committee members.

He is being made aware that in view of the owners that have been turned against him. The whole committee has a responsibility to earn the confidence of those that doubted them. This was our first task after being re-elected.

Sadly we are still having to waste resources in money and time fighting for MI Sol's right to have the representation of IT'S Choice, and not the choice of Juan Lavado, Antonio Escudero and Dianne Carroll.

Your committee continues to need your support. Please do not tolerate these mischief makers.
