In the town of Torrevieja, Alicante, at ten hours of the first of October of two thousand and six, met in general Ordinary Meeting, the owners of the community “Mi-Sol Park”, in second convocation previous convocation in the Bar of the community where the next owner assist or are represented, being invited the lawyers of the community Dña. Rosario Andréu and Dña. Fuensanta Alenda of the company Andreu & Alenda, Abogados, passing next to treat the themes of the day order, adopting the next agreements:
In the first moment the president D. José Riquelme thanks all for their coming to this meeting, reflecting in the minutes the gratitude of him and the committee for any support given by the community, and apologize about the reclaiming by the justice the community fees, water and electricity receipts paid to D. Antonio Escudero, in stead paying them into the community account.

FIRST.- Approval of the balance of the previous exercise.

SECOND. Measures against debtors.
The meeting agrees to take to a juristic consultant’s office the outstanding amounts like fund provisions, finished amounts, extraord. Amounts, etc. Approved in a meeting and not paid by the owners to the community; agreeing also that all the expenses created by this must be paid by the debtor (previous reclaims, conciliation acts, lawyers etc. Also when the law does not mention it) like also the debt finance or bank overdraft caused by this, using the law Ley de Propiedad Horizontal 49/1960 changed by the law Ley 8/1999.
Next are read the debtors at 31 08 06, including the amounts of the exercise 2006 plus the corresponding water and electricity bills until this date, the list is reflected next.

Dña. Rosario Andreu and Dña. Fuensanta Alenda inform about the proceses against the debtors agreed in the last general meeting, most of the debts are paid (debt at 31/12/2004) and that this proceedings will go on.

In reference to the rest of the processes, and especially to the sentence concerning to D. Antonio Escudero about the minutes of 22nd of February of 2.003, then it’s read one of the sentences (Sentence by the judge Dña. Eva Martínez Pérez, verbal judgement 1370/05 at the court Juzgado de 1ª Instancia nº3 de Torrevieja) :
“… In the present case, the problem starts because the defendant in this present case, like other owners, are paying to D. Antonio Escudero Baños, which elected himself as president of the community, as agreements of the meeting of 22nd. of February of 2.003. This question has the origin in the confrontation within the community when two communities were constituted and worked in parallel organizing problems. In this order Sr. Riquelme like also Sr. Escudero act like presidents of the community at the same time convoking meetings and adopting agreements, this has caused that some owners are for this or the other side, or like they understood the case, they came and paid their bills to one or the other, producing in the practice a total and chaotic organisation against the interests of the community. Because of this situation and see to solution this problem there was convoked a meeting in September 2003 were the elected president is Sr. Riquelme. This meeting was impugned by some owners, inclusive Sr. Escudero, but his demand was rejected by sentence 29th of January of 2006, in the edict of ordinary justice 293/04 of the court “Juzgado de primera Instancia nº2 de Torrevieja”, previous allude, and as indicated this proceeding is not finished because it’s appealed, his power comes from the article “Artículo 18.4 de la LPH”, and in consequence the president of the community is Sr. Riquelme, and not Sr. Escudero and because of this and for the future

The payments made to the same are not valid and are not possible to oppose to the acting community, because of this the certification send by Sr. Escudero, together with the edict, is not eminent because there is not a legitimized to send this certification. Not paying in the right place and either to the authorised person for it, proceeding that there exist a debtor over the reclaimed amount and condemn the demanded person to pay the reclaimed amount.”
The government board of the community invites all the owners to come to the community office or administration and see all the documentation about accounts or other themes you want, and in the case that the debtors of the last meeting are not paid in this present, they can verify their statement with the lawyers.

THIRD .- Modifications in the government board.
It’s proceed to ask for candidates for the government board of the community (committee), presenting for re-election the actual government board with the president D. José Riquelme, his post goes on and proposes the next changes and after the corresponding votes the next one is agreed:

D. José Riquelme wants to reflect in the minutes that he thanks the assisting owners for their trust in the government board of the community, indicating that once the community is regulated and resolved the existing problems he will delegate his function in the government board.


FOURTH.- Approvement of the budget for 2.007

Water and light bills.

It’s agreed that the amounts of the bills for each owner will be actualised as the community is paying for them, like indicated next:

It’s indicated that this amounts are from 2.005 and that the prices will be actualised with the bills presented to the community.

a) Quotes 2.007
After the study of the budget for the next exercise of 2.007, it’s agreed to increase the amounts for 2007 in 5%.

FIFTH.- Any other business.
Come to this point the next was discussed.

1.- It’s indicated that the community account in Banco Popular is blocked waiting for the juristic answers about the petition of D. Antonio Escudero and not because of court order like some explain in the community. Also it is agreed to authorise the government board to open an other account in the name of the community to avoid that the account is blocked because of any questions.

2.- It’s proposed to close the toilets, this is approved by majority, it’s explained that this will not be done immediately, it will be done bit by bit, and always studied by the government board of the community because this is a camping.

3.- It’s proposed and accepted to ask for a budget for some kind of fire foresight, this question will be studied by the government board with budgets and always depending if the community has got enough money.

4.- It’s proposed and accepted to install entrance and exit signs in the urb.

At 14.00 hours of the same day the meeting is closed.
