7/2/2004--Committee Meeting.
The meeting was curious to here what happened at the court appearance. Pepe Sheila and Simon have been summoned to answer criminal allegations that they stored Mi Sol funds in an account in their three names. The evidence was in the form of photocopies of cheques and bank payment documents. It was a mystery how our new bank supplied these documents to Escudero. Which can now be explained.
Pepe Simon and Sheila were separately called before the judge and were questioned by the prosecuting lawyer. When asked who gave you permission to open a bank account in your three names:- " I represent 265 owners on Mi Sol, It is my duty to protect their interests and hold their funds securely" was the answer. We went on to explain to the court that following our Re Election in September 2003 we visited the bank to change the name of the account To Mi Sol. This was not actually possible so a second account was opened in the name of Mi Sol. As a precaution against a repeat of actions made against our Caja Murcia Account, it was decided that the bulk of the balance still be held in the three names account.
Simon was asked to confirm that Pepe was indeed an owner on Mi Sol. He replied that to the best of his knowledge Pepe and Antonia shared ownership of their home on Mi Sol.
Sheila was asked whether Antonio Escudero was angry after he failed to be elected president at the 2003 AGM. She replied that "He was probably disappointed" After we were questioned before the judge , we were excused. No decision was made.
The court case against Escudero is due to be heard on the 3rd March 2004.
The meeting was informed that the bank was questioned how they supplied Escudero with information re the account which emerged as the only actual evidence that was held against Pepe. The bank informed Pepe that no third party had requested any information and one of the documents confirmed that all this information had been posted to a mail box which Simon shares with a number of other owners on Mi Sol. It was addressed to Jose Riquelme Lorenzo Apartado 5155 . Torrevieja. It should have been addressed to Simon at that Number. One of the key holders of that box collected this mail. Instead of delivering it to Pepe and asking him why post addressed to him was being delivered to this box. THEY STOLE IT!!! And it found it'self in the possession of their lawyers. Had this come to light before the court appearance we could have informed the judge that the evidence against us was stolen property.
This behaviour will be reported to our lawyer.
The committee meeting was informed that the telephone has now been restored in the office with the original number.
Clara needs to be contacted with reference to the Mi Sol land that has been enclosed by a wall around the old supermarket building.
Roy Whalley needs to be written to regarding the Mi Sol land he has enclosed (With the permission of the august 2002 committee meeting) in view of the fact that he is considering selling this 272.
number 200 is experiencing problems with his drains. The engineers report that the problem is inside the house it'self.
The 3 name account is no longer in use and will be closed.
The treasurer reported that he has met with the bar tenant. He asked him to pay what he could before this meeting to demonstrate good faith. He has failed to do so. It was agreed that the lawyer who drew up the original rental agreement for the bar be instructed to contact him to request immediate settlement.
