Commitee Meeting June 5th 2004
The June committee meeting was held on the pool terrace and all owners where invited to attend.
Acknowledgment was made of the recent death of John Mountford and the president offered his condolences to his family.
Pepe showed the meeting a document from Banester Bank. They held the funds deposited by Caja Murcia when Antonio Escudero caused our money to be frozen in April 2003 by presenting the Caja Murcia with the acts of his meeting where he appointed him self president. As the judge has now confirmed that meeting as void these funds are now to be returned to us. (The amount of €45681.00 has been credited to our Banco Popular Account on 8/6/04)
As the amount originally frozen was in the region of 69000 euros and it is known that after that some owners continued to make payments to Caja Murcia our lawyer is now taking steps to find out what has become of the 23318.00 shortfall plus any other credits made to that account. Any expenses must be justified.
The Cam Bank Statement reveals Antonio Escudero collected an amount in excess of 30,000 euros via the CAM bank account during the period of up to the 2003 AGM. He and Marie Jenkins co signed a number of cheques spending around 27000 euros so far without submitting any justification for these expenses to the treasurer. Further to that, following the confirmation by the 2003 AGM of Pepe to continue as president, instead of relinquishing control of the remaining funds in the Cam Bank, Antonio Escudero and Marie Jenkins wrote a further two cheques clearing out the remaining balance in the region of 3.000 Euros. Steps have to be made to recover our funds or justifications for any Mi Sol expenses incurred by Antonio Escudero during the time he considered himself president.
All owners are to be notified of the court decision in favour of our democraticly elected President. Since the 2003 AGM ONLY PAYMENTS MADE TO THE MI SOL PARK BANCO POPULAR ACCOUNT ARE RECOGNIZED LEGAL PAYMENTS TO MI SOL Owners who have been duped into paying any other party are to be urged to seek refunds from Antonio Escudero and Juan Lavado. Once this money has been paid into the proper account, owners accounts can be properly credited.
The swimming pool is now open. Pool cards will be issued in July to owners who's accounts are in good standing with the community. Please use this months grace to get your accounts in order.
Owners are reminded that whilst they are at perfect liberty to conduct personal business with the town hall. For Mi Sol business there is one and only one legally appointed representative. THE PRESIDENT. Owners have no business making unauthorized approaches to town hall departments on Mi Sol Business. This practice compromises the long established good relations and tolarence which we enjoy with the Town Hall. Owners who take it upon themselves to short circuit this chain of communication with the town hall are doing more harm than good.
As a consequence of this un invited interference by members of the community. Our efforts to put Mi Sol on a legal footing and remove any uncertainty of what the future may hold have been derailed. The individuals responsible for this can have the blame placed firmly at their door for any deterioration in our relationship with the town hall.
Mi Sol's dustbins have now been removed from the site and the president has to take time out to have a meeting with the town hall to resolve this.
