Minutes Committee meeting 6/3/2004
The meeting was informed of the judgment of the 3rd March where the judge confirmed Pepe to be the legally elected president until 2006. Caja Murcia have made arrangements to transfer on the judges instruction 45000 euros into our banco popular account. It was pointed out that the original sum removed from the account was in excess of 69000 euros. It is also known that some owners continued to deposit money into this account.
An explanation is required as to the large shortfall in this refund from Caja Murcia. We are still awaiting justification from Escudero and Marie Jenkins for the amount in excess of 30000 euros that was collected into the Cam Bank account and removed by them. The meeting is informed that Dianne Carol informed owners in a letter were she declares herself Secretary that Juan Lavado is collecting money on behalf of MI Sol. Our lawyers must collect information of any such transactions which are completely without legal mandate.
The meeting was informed that Juan Lavado has offered an estimate of 15000 euros to administer Mi Sol. As this is obviously the carrot that has been dangled in front of him for so long, encouraging his outrageous conduct, the following has been agreed.
An administrator will be appointed to ensure correct procedure without delay. This will protect members from cowboy tactics which we have been subjected to by members attempting to short circuit the democratic process. It is hoped that by taking matters of financial accountability out of the domain of committee members, members confidence in our park management practices will grow. A professional administrator will be expected to protect the community from the loop holes that have been exploited by Juan Lavado and his clients in an attempt to force their will on the community. An administrator would be expected to oversee the legality of calling meetings. Fair elections without prejudice. By making the post of Administrator to Mi Sol no longer vacant, this individual will cease his "ambulance chasing" tactics and pursue his "Walter Mitty" ambitions elsewhere.
Simon Edgington acknowledged that everyone from both sides of the fence were satisfied with the work being carried out by Juan the gardener. He proposed that the arrangements made by Escudero to employ him be honored and continued. The president mentioned that he had spoken to the gardener to that effect. The meeting was informed that the gardener expressed fear of retaliation from Paco the taxi driver if he agreed to work for our committee. Hope was expressed that such fear was unfounded and that the gardener would indeed continue with his good work.
PACO's REPLY
Comment was made regarding Dianne Caroll's continuing practice of campaigning for what she considers to be Truth and Justice. She mentioned a requested AUDIT. As her followers have removed the 2002 Receipts file only the reflected records remain in the computer. An auditor has been consulted with regard to 2003 but we are still awaiting justification of moneys frozen in Caja Murcia and monies which passed through the control of Escudero and Marie Jenkins. 2004 has seen the introduction of a better accounts program which is enabling our accounts to be audited and balanced on an up to date monthly basis. The 3 named account has been closed and all Mi Sol funds are held in The Banco Popular in the account named Mi Sol Community of Owners.
Any meeting called by Dianne Caroll cannot legally be recognized as an AGM. She is deluding herself that she is secretary. One has to question the sanity of such persistence in the face of legal confirmation through the courts to the contrary. Regret is expressed to our members that such a vicious, irresponsible individual has been able to obtain a mailing list and persists in using it to bother and disrupt our community.
