Neill opened the meeting announcing that the bank balance is now 21,767 Euros. Alberto is owed 4,673 Euros fees . A cheque valued 701.euros portador was made out to cover the data protection invoice, office materials and an overpayment error on APYME’s part of 447 Euros.
150.Euros has been paid cash (from the petty cash) to Madrid towards the barristers fees.
Marie Jenkins has agreed to reduce her debt with monthly payments as has Mrs. Barker. Mrs. Jenkins also arranged a meeting with APYME, but telephoned and cancelled it.
Neill is concerned about the attitude of some owners accusing this committee of doing nothing in the four months of being in charge. 44,775 Euros has been paid out just to keep Mi-Sol Park operating and a list of all outgoings is printed and shown on the notice board outside the office, and on the bar door.
Owners threatening to withhold fees do nothing to ease the situation, and in fact they only make it worse, as without the community fees we are unable to implement everything that could be done, but have to prioritise instead.
The gardeners will be starting the 2nd phase of clearing Mi-Sol Park of all debris etc. at a cost of 4500.00 Euros. This work will take approx. 8 weeks. The committee voted unanimously to negotiate a contract for the future upkeep of Mi-Sol Park.
Regarding the Swimming pool: After due consideration the quote for 38000.00 Euros to rebuild the pool has been further negotiated by Neill and it was voted by the committee to go ahead - paying 10000.00 Euros deposit and 2 further payments of 5000.00 each. The remainder of the monies to be paid on a monthly basis of 2000 Euros, this to include the maintenance of the pool throughout the year.
Neill wants to make it understood that any owner calling in workmen for repairs to be carried out on Mi-Sol Land will not be paid unless authorised by Neill
The car and trailer are due to be tested. The car is in a poor condition and will cost at least 400 Euros to repair. It was decided not to incur this expense, so a new battery will be fitted and the car can be used on site if necessary.
Plot 582: The cheapest quote is 400 Euros supplied by Lucas. It was agreed for him to do the work and the reimbursement to be credited to his account.
A certified letter from Paco wanting the keys to the swimming pool in order to repair it has been received. Neill replied, informing him that if he (Paco) would stop collecting money under false pretences from owners, and paid the existing money received for water and electricity into the Banco Popular, there would be enough money to repair the pool. Paco was also informed that a copy of the bar contract was available for ANY OWNER to read in the Mi-Sol Office.
The bar is in debt to the value of 8000.00 Euros. An agreement was made between Neill & Bob for a standing order of 750.00 Euros to be paid into the Banco Popular each month. This agreement has not been kept by Bob, which renders him in breach of contract. It was decided to wait until he returns from Thailand before any decisions are made.
Another certified letter arrived from the Social Security with a debt of 250 Euros plus a fifty euros fine. This should have been paid by Pepe as it relates to the gardeners contributions.
An electrical engineer has inspected the non-working street lights, but is unable to repair them as they are too high and he does not have a cherry picker. Other options are being looked into such as new energy efficient street lights to replace the old non-working street lights
An owner has offered to undertake the drainage problems on Mi-Sol Park if the correct equipment is purchased. This is also being looked into.
Plot 10 has been broken into, and it was decided not to inform the owners again, as they have already been informed once.

MINUTES TAKEN BY APYME
MINUTES OF THE GOVERNMENT MEETING OF MI SOL-PARK, HELD ON THE 19TH OF FEBRUARY OF 2.008.
In the town of Torrevieja, Alicante, at sixteen houres of the nineteenth of february of 2.008, met in government meeting, in fist convocation in the bar of the community where the members of the government board of the community assist, passing next to treat the themes of the dayorder, adopting the next agreements:
The meeting is startet by D. Neil Stacey thanking all for their comming, informing about:
1.- BANK BALANCE:
It’s informed that the community actually has got a bank balance of 21.000’00 €, and that the situation of the exercise is better than the last one, informing that the expenses of the last 5 months are over 44.00’00 €, indicating that it’s not possible to make more because of the not existing funds in the community account, but all the necessary repairs are made.
2.- DEBTORS:
It’s given to the administration a list of debtors to make the certifications for the lawyers, corresponding to unpaid quotes.
3.- ADMINISTRATION:
It’s informed about an outstanding amount over 5.000’00 € to the administration, this debt will be paid monthly of 1.000’00 €, paying in this moment the amount of 701’19 € for office material and other pending payments.
4.- PROCESS IN MADRID:
The payments to the “procurador” are made, and it’s pending the payment to the lawyer, waiting for information about the process.
5.- POOL:
It’s aproved by mayority the budget presented by POOL EXPERT over 38.000 €, payable of 20.000’00 € when finished the repair (10.000’00 € at the beginning, 5.000’00 € once started the works 5.000’00 € when finished) the rest will be payd monthly 1.500’00 €.
It’s also approved the maintenance during the year over 500’00 € each month.
It’s read the letter of Sr. Martínez, asking for the keys of the pool to repair it and the answer made by the presidente indicating that this is a community problem and that the community has got to resolv it, requiering him about the previous agreements (that his part pays for the water and electricity into Banco Popular) indicating him that in the case of not sufficient fund the pool will not be opened next summer.
6.- CAR:
It’s informed that the communities car is in a bad conservation, and the budget for the repair is over 400’00 €, leaving the decision in the hands of the president.
7.- PRUNING:
It’s informed that the trees has been pruned and that the next friday 22/2 they come back for desinsection.
8.- CLEANING AND GARDEN:
It’s read the budget presented by BOOKER GARDEN SERVICES for the maintenance of cleaning and garden over 4.500’00 €, it’s agreed this company by mayority.
It’s spoken about the cleaning of the inside of the circles, there are owners who paid for this and now the company will do the work, explaining that in the case just the outside will be done this work won’t help anything, thanking the owners for their help in the maintenance of the cleaning inside and outside of the houses.
9.- DOGS:
It’s informed that there are dog’s loose in the community also when there are signs in the community and in some cases it’s asked the help of the owner.
10.- NUMBER 582:
It’s agreed the budget presented for the stucture next to 582 over 400’00 € (this structure is dangerous in this moment).
11.- BAR:
It’s informed about the tenant of the BAR of MI SOL PARK that he is not carrying out the contract (there are realised other activities of the Bar/Cafetería) he is not paying the agreed rent, authorising the president to take the best option, including court option.
12.- SOCIAL SECURITY:
It’s informed that the community still receives notifications of Tesorería de la Seguridad Social about unpaid social security (of the time from D. José Riquelme) also some about the gardener contracted by D. Antonio Escudero (using the CIF of the community) over about 3.000’00 € wich are not solved by D. José Riquelme.
13.- DRAINS:
It’s informed that there is an owner offering himselfe to repair the drains of the community and just get paid the material for the works, this is aproved unanimously.
14.- EXTRAORDINARY MEETING:
The president informeds that the negociation with D. Francisco Martínez have no solution, and it’s not convenient to realise a extraordinary meeting for easter without any advance in this theme.
At eighteen houres of the same day the meeting is closed.
