Informal meeting called by Spanish Owners to resolve differences. 10.00 for l0.30am.
The Spanish held their own meeting at another venue after which they arrived at the meeting proper. Neill asked them if they would explain their intentions how to resolve the problem in view of the outcome of the court case.
Lavado refused saying that he was willing to answer questions. The first question put was how many Presidents are there? He replied saying there were 2, Paco and Neill.
Neill made reference to the paperwork issued by the court reiterating the judgment.
Their reply was to refer to the conditions in writing that were presented to Neill at an earlier date. Lavado suggested that the issue should be put forward at the AGM in September where there could be a vote taken.
Neill replied that any owner who has failed to pay his fees into Banco Popular will be in debt and will forfeit his vote. They replied saying they have paid their fees and want the two committees to meet to resolve the dispute.
Neill agreed to consider whether payment had been made or not on the production of bank receipts, and will act on the advice of the Administrator.
He stressed again that he was the President, having been legally voted in at the last AGM which has been affirmed by the courts. All owners are obliged to pay their fees, electric and water into Banco Popular.
A long discussion followed with regards to the re-installation of the entrance gated, Neill responded with an explanation of the judicial proceedings currently taking place where a judgment is expected in the next six months allowing the re-installation to proceed without the necessity of approval at an AGM, this being the proposal of Lavado which would require 100% votes. The advantage of waiting for the courts judgment, the appeal is an extension of the original proceedings which pre-dates the 100% rule.
Agreement was reached that both Administrators meet with accounts from both sides to consider the way forward. The Spanish requested the presence of their lawyer to which Neill disagreed.
It was finally agreed that no lawyers need be present.
Neill will be speaking with the Administrator on Monday.
